In response to our lengthy discussion on WhatsApp regarding interpretations of the roster limit rules, I propose the following is added to the league constitution.
In the Major League Rosters section:
Teams are not allowed to exceed 40 MLB players at any point in the year, including the off-season. In conjunction with our IL rules, players must be officially on the IL before a manager is allowed to replace the player with someone else. If a team is caught exceeding their roster limits, the following penalties apply:
a. 1st offense = warning and a 24 hour period to correct b. Future offenses = $1 million fine or 1st round pick if cap space has been extinguished
In the Minors section:

Agree with the recommendations, the roster limits mirror the MLB and set a level playing field for all by establishing thresholds everyone must abide by, year round. Anyone exceeding those limits is seeking a competitive advantage and should have consequences for doing so.

My only suggestion/idea would be about the future offenses. This is mostly just spit balling but maybe making the fine 1 M, or third, second, then first? I feel like the 1 M fine, and the first round is pretty unequal (I would think most people would value the first rounder much higher than 1M) and it would make sense that repeat offenders would get a higher level of punishment. That being said, I would still probably agree to this even if it stayed as is.
Or maybe making it first rounder or 3-5M since as dodgers said and I agree, the competitive advantage can be quite large if this is taken advantage of in certain ways.
